What is a break clause?

A break clause is a term written into a tenancy agreement allowing either the tenant or landlord (or both) to end the tenancy early, provided correct notice is given.

Under the Renters' Rights Act's periodic tenancy model, tenants already have more flexibility to leave than under the old fixed-term system - but a break clause can still matter for the notice period required, or for any minimum-stay conditions a landlord includes in the agreement.

What to check before signing:

  • How much notice does it require?
  • Is there a minimum period before it can be used?
  • Does it apply to you, the landlord, or both?
